Riviera Sunrise Rental Agreement And Various House Rules, Policies and Procedures Thank you for choosing to stay at our beach house, which we refer to as “Riviera Sunrise.” We truly hope your stay will be wonderful! Please do not hesitate to reach out to us with any questions, issues, or if you just need a recommendation on where to go or what to do in PC Beach. This rental agreement establishes all terms and conditions for the short-term rental of Riviera Sunrise. This property is located at 116 Riviera Drive, Panama City Beach, Florida 32413. As the Registered Guest, please review, sign, and return to us promptly in order to secure your preferred dates. We are happy to answer any questions you may have pertaining to this document, and we recommend sharing this information with all the adult members of your party. BOOKING/ RESERVATION REQUIREMENTS AND PRE-ARRIVAL DETAILS 1. The individual that books the reservation online shall henceforth be known as the Registered Guest. The Registered Guest also assumes responsibility for signing this document. 2. To reserve online or via direct pay as a Registered Guest, you must be at least twenty-five (25) years of age and be one of the guests in your party residing at Riviera Sunrise for the entire duration of the requested dates. 3. Pre-arrival: As the Registered Guest, we require a copy of your government-issued photo ID no later than 3 days after booking online or paying directly. The ID serves several purposes, most importantly to positively verify your name against your reservation, and to help prevent against payment/credit-card fraud. Some pointers: a) A current and valid driver’s license, State ID, military ID or passport will suffice. You may redact other private information details on the document/card (in particular, your Social Security Number) with exception of your name and birth date. b)You may send a photo of the government-issued ID through the booking platform, email or text, whichever is easier for you. c)Around 3 days before your arrival, we will send you, the Registered Guest, the front door access code after receiving pre-arrival information, such as your current and valid ID and guest names. 4. As mentioned, we require a list of the names and ages of all members of your party who will be sleeping at Riviera Sunrise. You may send this list to us via the booking platform, email, or simply write the information on the same sheet as your driver’s license, whatever is easier for you. 5. We do not accept 3rd party bookings. 6. We do not refund for no shows. 7. Reservations made under false pretenses are subject to termination and forfeiture of all monies paid. 8. We recommend that you secure travel insurance to cover any potential issues that may require you to cancel your trip. This allows you to get a refund if you have to cancel your trip last minute for reasons that are covered by the travel insurance policy. We do not offer refunds past the refund date outlined on the platform. PAYMENT - Payment conditions may vary by booking website, or when paying us directly. VRBO/Airbnb.com listing sites - Generally they require full payment up front, but recently began providing some accounts with a Pay Less Upfront option, which can split into 2 payments. RESPONSIBILITY AND LIABILITY The Registered Guest is responsible for payment and other facets of the responsibilities as outlined in this rental agreement. The Registered Guest assumes financial responsibility for damages or loss caused by negligence or deliberate abuse to the structure, furnishings, appliances, equipment and grounds (wear and tear from reasonable use and damage by the elements are excepted). The Registered Guest also agrees and acknowledges that they will be responsible for all costs arising from damages to the Riviera Sunrise property that are found to have occurred during the dates of their stay, or caused by anyone in their party, or that may interrupt the next Registered Guest’s stay, and therefore result in loss of rental income to 116 Riviera LLC / Owner. You, the Registered Guest agree to permit us to retain your credit card on file in the event of any damage to the Riviera Sunrise property incurred during the dates of your stay. Some repairs/replacement of items or damages may take time to determine actual costs. We will make our best effort to determine these costs in a timely manner, and share the information and any charges with you. The Registered Guest understands and agrees that it is the responsibility of the adults in their party to safeguard minor children in their party. At no time should minors be left at the Riviera Sunrise property without the presence and supervision of other adults in their party. The Registered Guest and their party are responsible for locking Riviera Sunrise, and we recommend that you and your party lock parked cars staying at the Riviera Sunrise property. Owner and property manager are not responsible for lost or stolen items. There is no lifeguard on duty at the community pool nor at the beach. Accordingly, when using the beach or pool, you as the Registered Guest and your party do so at your own risk and the Owner assumes no responsibility for accident or injury. No one should swim alone. You, the Registered Guest and your party will hold the Owner harmless from any and all bodily injury and/or property damage incurred on the Riviera Sunrise property arising out of negligent acts or omissions on behalf of you as the Registered Guest and anyone in your party. See disclaimer below. The Registered Guest and their party hold harmless 116 Riviera LLC, the Riviera Sunrise property Owner, and any property managers / officers from any liability issues including any injuries and/or illnesses contracted during the stay. The Registered Guest and their party understand there are inherent dangers located on, around and in a single residence property (such as stairs, balconies, ledges, overhangs, stoves, tubs, showers, grill, etc.). The Registered Guest and their party assume all responsibility and will not hold 116 Riviera LLC and/or the Riviera Sunrise property Owner liable. SELF CHECK-IN AND KEYLESS ENTRY PROCESS Check in is at or after 4:00 pm central time. We make every effort to ensure that Riviera Sunrise is fully cleaned and ready for occupancy by 4pm central. If Riviera Sunrise is available for an earlier check-in, we will let you know. Please schedule your arrival to coincide with or after check-in time. Riviera Sunrise is equipped with keyless locks, making your check-in process fast and convenient. We will send you, the Registered Guest, an email containing important information (including your door entry code) up to 72 hours before your arrival date. The code will not be active until 4:00 pm on the day of your arrival and will terminate at 10:00 am on the day of your departure. Repeatedly entering the wrong code or tampering with the keyless lock could lock you out. Please explain to small children that the keyless entry is not a toy. If this occurs, no worries, as we can resolve this issue remotely after hearing from you. SELF CHECK-OUT AND DEPARTURE PROCEDURES Check out is at or before 10:00 am central time. Our housekeepers need every minute after check-out to prepare for the next Registered Guest. Kindly depart on time. A late departure fee of $250 per half-hour will be charged to Registered Guests who remain on Riviera Sunrise property after 10am. Before you leave, please read and follow the check-out procedures shown below: 1. Remotes – Make it easy for our cleaning team, and future guests, by placing the TV remotes next to the TV that each controls. If our cleaning team cannot find all the remotes, you may be charged for replacements. 2. Dishes - Collect all dirty dishes, glasses, etc. and run the dishwasher on a one-hour cycle with heat dry. It is acceptable for the last load of dishes to be left running when you leave. 3. Laundry - Place colorful beach towels in the garage washer and start the wash cycle before departure. 4. Fridges/ Pantry - Remove all food, beverages and miscellaneous items from the refrigerator and pantry. Either throw them out or take them with you. You may leave unopened beer, wine and soda (Thanks!) 5. Trash - Collect and bag all recycling and garbage (inside and out). Place all trash bags into big bins in the driveway. Tip: We aim for no dishes on our last day. We clean out the fridge/ pantry and trash the night before and go out to breakfast the day we leave! 6. A/C – Kindly set air conditioner temperature to 76 in warm months and 64 in cooler months. 7. Please lock doors behind you. Recall that check out is at or before 10am, after which the entry code expires. 8. Failure to comply with the procedures listed can decrease the speed and efficiency of our cleaning turnaround, could bump into check-in for the next Registered Guest, and therefore may result in additional charges over and above the late departure fee. Please pay it forward by doing your part to help us provide a great stay for the next Guests, as the party before you likely did for you. PARKING Parking is limited to one vehicle in the driveway. Parking on the road and on/in front of the rock area to the north of the house is prohibited. The Registered Guest and their party agree to respect the posted parking notices/ signs, use common sense and be respectful towards neighboring houses. Any police enforcement actions by the City, County, or HOA security are at the sole risk and expense of the Registered Guest and their party, and may result in termination of your stay without refund. If you have any questions about parking, please ask us directly. TRASH AND RECYCLING - PROTOCOLS No need for you and your party to sort/ separate garbage versus recycling in PC Beach; all trash is collected together in the same big receptacles (bins labelled “Waste Management”). Our 2 big bins are typically located by the garage; you may store these bins either inside our garage or outside; however, we count on you, the Registered Guest, and your party to be sure that the trash bins are placed on our driveway (ideally by our curb) on Mondays and Thursdays evenings for regular pickup. We also count on you to please bag and tie your trash securely to reduce any leakage into the big bins (reducing the chances of stinky trash baking at 90 degrees; thanks for your help keeping the area sanitary!). If you choose to leave the big bins outside the garage during your entire stay, you may move the bins to the North side of the house on the rock next to the spigot/ hose for more garage space. The City provides each house with a maximum of 2 big bins per pickup. If your trash exceeds the 2-bin max and you try to leave loose garbage bags, you the Registered Guest will incur a charge from the City and we are told this charge can be quite high. You are responsible for dealing with excess garbage if the two bins become full; this is not cleaning’s responsibility. Panama City Beach provides blue trash receptacles on the beach for your convenience – please use them. OCCUPANCY AND PARTY SIZE We do not charge extra fees per person, but occupancy (including adults, children and infants) is strictly enforced in accordance with the fire code, tourist permit, insurance restrictions, and preventing overload at Riviera Sunrise. As the Registered Guest, you agree and affirm that you and your party will consist of the number of adults and children you included when booking. At no time will the number of overnight occupants at Riviera Sunrise exceed the maximum capacity permitted (14 Guests). Over-occupancy is a violation of your rental agreement. It is also an insurance and a permit violation - you will be evicted without refund, be charged $500 additional, and may be cited with a civil fine by the local authorities. The Registered Guest is not authorized to let or sublet all or any part of the premises nor assign the lease or any interest in it without the prior written consent of the Owner. CAPACITY CONSIDERATION AND NOISE ORDINANCE Riviera Sunrise is to be used for the quiet enjoyment of our Guests and is not to be used for parties, large gatherings or receptions beyond the sleeping capacity of the home. If you have need of a group facility or large gathering place, we can make recommendations. Riviera Sunrise is located in a neighborhood with a Noise Ordinance in effect from 10:00pm - 7:00am. The Registered Guest and their party agree to respect the Noise Ordinance and use common sense in keeping the noise volume low after dark. Any police enforcement actions by the City, County, or HOA security are at the sole risk and expense of the Registered Guest and their party, and may result in termination of your stay without refund. CLEANING CONSIDERATIONS The cleaning of sandy floors, multiple bathrooms, several kitchen areas, outdoor balconies and the overall house, multiplied by the complexity of 3-stories, takes considerable time. The cleaning fee assigned to Riviera Sunrise reflects the high standards we expect of our cleaning team. Upon check-in, please review Riviera Sunrise and contact us immediately if it is not cleaned to your satisfaction. Our cleaning team will correct the problem in a timely manner. Upon check-out, please return the remote controls for all electronic equipment (TV’s) next to the devices they control. This is for the ease and speed of cleaning, and to avoid them wasting time searching for these items. UPKEEP OF GRILL, SMALL APPLIANCES AND GAMES BIN - POLICY We do not hold our cleaning team responsible for the inspection and cleaning of the games bin, the grill, and small kitchen appliances such as the blender, the crock pot/ slow cooker, the griddle, the waffle maker, etc; we trust that the cooks will clean up after themselves and folks will leave household items in good shape for the next party. The Registered Guest and their party are responsible for the care and clean-up of the games bin, all dishes, placemats, pots, pans and small appliances, including the natural gas grill. Kindly notify us immediately of any cleaning concerns upon arrival so that we can do our best to assist and rectify the situation quickly. As for major appliances, such as the refrigerator, please do not change the settings or temperatures. TOWELS/ LINENS / STARTER KIT SUPPLIES Bed linens and white bath towels are provided for the use of the Registered Guest and their party but remain the property of the Owner. Please do not remove bath towels and/ or linens (including blankets and/ or comforters) from Riviera Sunrise, in particular do not take them to the beach. Furthermore, kindly refrain from leaving wet towels on the beds. Hooks and towel bars are available for your use. We have personally used the door handles in the bedrooms. We provide a basic “Starter Kit” with some items that anticipate several initial guest needs. In addition, for the convenience of you and your party, some initial toiletry items are provided at check-in such as soap and paper products (toilet paper). You may need to purchase additional supplies during your stay. FURNITURE Please do not remove or exchange furniture or other items in our beach house. Keep all inside furniture inside the house, and all outside furniture outside the house. Do not rearrange furniture or hide decorations. The cleaning team may think items are missing and/or broken, and you, the Registered Guest, could be charged for these items. Please, no standing, sitting or dancing on any of the tables and countertops. PET POLICY – NO ANIMALS We do not permit animals of any type into Riviera Sunrise as we welcome many families with dander allergies. Any Guest(s) found with an unauthorized pet will be charged a fee of $500 and evicted with no refund. There are kennels in the area, please ask if you need a referral. INTERNET SERVICE AND TV Riviera Sunrise is equipped with complimentary Wi-Fi internet access. We do not guarantee, nor can we be held responsible for, internet connectivity or internet speed. If cable or internet service is out, please alert us immediately and we will work diligently with the provider (Xfinity) to restore the service as quickly as possible; note that a service call may be required to solve the problem. No refunds will be given or money prorated for cable or internet access problems. Additional charges may apply for technical support needed due to issues not related to Riviera Sunrise’ internet access, such as Guests’ computer error in configuration or Guests resetting the modem. We do not offer Cable TV. All TV’s located in Riviera Sunrise are smart TV’s, so you are welcome to log into your favorite streaming apps during your stay. Purchasing any features, movies or shows outside of your own account (i.e. OnDemand or Pay-Per-View) is not permitted. If this does occur during your stay, you will be charged for any incidental purchases made while occupying the house. Although we have not had any issues ourselves or from previous Guests, we cannot guarantee that your cell phone will work at Riviera Sunrise, nor will any refunds be given in this instance. We recommend using Wi-Fi for your internet needs, and your phone for phone calls. The Wi-Fi password will be provided in the Welcome email. TERMS OF INTERNET USE The internet service provided is for the personal use of the Registered Guest and their party. The Registered Guest and all those in their party agree not to use this service in a manner prohibited by any federal or state law or regulation. Transmission of any material in violation of federal or state law or regulation, including, but not limited to any copyrighted material, material protected by a trade secret or material or messages that are unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable in any manner or nature or that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national or international law or regulation, is prohibited. Riviera Sunrise Owner/property managers will fully cooperate with any law enforcement investigation into illegal internet usage. We assume no responsibility for the content contained on the Internet. All content accessed or received by the User is at his or her own risk, and we shall have no liability resulting from the access or use of such content by the user. NO SMOKING OR ILLEGAL ACTIVITY We do not permit smoking of any kind (including tobacco, vape, marijuana and e-cig) nor is any illegal activity (including drugs) permitted inside Riviera Sunrise or on the property. Smoking anything inside the house will incur a cleaning charge of $1,000 plus damages, including but not limited to the loss of rental income from future Registered Guest(s). Smokers should plan to smoke away from Riviera Sunrise property, and to properly and safely dispose of all smoking waste. SAFETY AND SECURITY The Registered Guest acknowledges the presence of 3 unmonitored exterior motion cameras on the front corner of the house, the front porch and the back patio. The back patio exterior motion camera also has a motion sensor light to create a well-lit area for back walkway area and steps. In case of a break-in resulting in theft, the Registered Guest may request camera footage that may aid in an investigation and recovery of stolen goods. There are no cameras inside the beach house or any that intrude on private space. Any tampering with or disconnecting the cameras will result in immediate eviction from the Riviera Sunrise property. In addition, we do not provide the code for entry through the garage door (we only provide the front door). The garage door cannot be updated remotely and it would therefore pose a security risk to have only one garage code for everyone. A fire extinguisher is located under the sink in the main kitchen. We hope that you never have to use it. FIREARMS No firearms are allowed on the premises. FIRE SAFETY Upon your arrival, please note location of the fire extinguisher under the main room sink and advise us promptly if it is missing. Do not tamper with smoke detectors or fire extinguishers. Immediately report any issues noticed with these fire prevention devices. No fires are permitted at Riviera Sunrise; no candles permitted on Riviera Sunrise property with exception of small candles used for birthday and celebration cakes. There is a community firepit by the pool that is available for the responsible use of the Registered Guests and their party, and others in the HOA. OWNER'S CLOSETS AND FURNACE ROOM CLOSETS Riviera Sunrise has two Owner’s supply closets, located on the ground floor and 2nd floor respectively, which will be locked during your stay. If you or your party find these closets unlocked, please advise us promptly. Any attempt by a Registered Guest or their party to open or attempt to open either or both of these closets without the express written permission from the Property Manager will be charged $500 for violation of privacy. In addition, we ask you, the Registered Guest, and your party, to refrain from opening either of the furnace room closets, found on the ground floor and 3rd floor respectively, unless done with the express written permission of the Owner. POOL - POLICIES AND PROTOCOL The community pool behind the house is available to you, the Registered Guest, and your party, between 8:00 am and 9:00 pm every day. The pool has been known to close for maintenance on rare occasions; if this is the case, the Owner will notify the Registered Guest promptly. The pool is shared by eleven houses that are part of a Home Owner’s Association (HOA). As the Registered Guest, you and your party are expected to use the pool in a responsible manner, including respecting the pool rules posted around the pool deck, and tidying up after yourselves. You, the Registered Guest, acknowledge and agree that there are inherent dangers using the pool and surrounding area; as the Registered Guest, you assume all responsibility for these risks and will not hold Riviera Sunrise, 116 Riviera LLC and/or the property Owner liable for any injuries and/or issues arising from pool use or activities around the pool. CLIMATE CONTROL - POLICY In warm weather, please do not set the A/C thermostat below 68° as it will cause the system to freeze up; do not turn on the AC at all during winter months or when outside temperatures are below 60°. Doors and windows should not be left open when Air Conditioner is running. This causes the A/C to freeze up and can ruin your stay. Should damage result from and A/C unit freezing, you, the Registered Guest, may be liable for repair costs. TOILETS - PROTOCOL Like most houses, Riviera Sunrise’s sewer system will clog up if improper material is flushed. DO NOT FLUSH anything other than toilet paper down the toilets. As the Registered Guest, you could be charged damages of up to $1,000 if we discover that you or your party held any responsibility for clogging the system during your stay. To prevent this, we have placed trash cans conveniently by the toilets in every restroom; kindly use the trash cans to dispose of tissues, wipes, feminine products, etc. and inform those in your party to do the same. PROPERTY USE AND PROBLEM NOTIFICATION - PROTOCOL We expect our guests to exercise safe, prudent, appropriate and cautionary use of Riviera Sunrise. We expect you, as the Registered Guest, to notify us immediately if you or your party notice any aspect of the Riviera Sunrise property that may warrant further attention and provide the Owner with a reasonable amount of response time to remedy the situation. Your silence indicates full acceptance of the unit and its condition. MAINTENANCE, REPAIRS AND HOUSE CALLS – POLICY AND PROTOCOL Riviera Sunrise is well-maintained and cleaned frequently. However, like any home, it may experience unexpected breakdowns or issues with utilities (electric, water, etc.), appliances (stove, dishwasher, etc.), or other household issues that are unexpected and beyond our control. If something is not working, please call or text us immediately. Every effort will be made to correct the problem in a timely manner. You can expect a courteous and professional approach to problem solving! However, refunds will not be issued due to malfunctioning equipment or 3rd party utility service problems. In the rare instance that a service provider, property manager, or Owner may require access to the house during your stay, for example to inspect or repair an issue, you will be notified as soon as we are aware of a house call. Timely notice is waived in emergency situations. INSECTS AND WILDLIFE – POLICY AND PROTOCOLS Kindly leave the doors closed at all times when not in use and be sure the screens are secured if windows are opened. Cobwebs can appear overnight - don’t make it easy for small critters such as spiders, flies, and local roaches to come in! Riviera Sunrise is professionally treated on a regular basis by a licensed pest control company. Despite these efforts, Florida is a warm weather environment and you may occasionally have an uninvited guest. If this occurs, please immediately advise us of the location, so that additional precautions can be taken. Refunds will not be given for visits from these natural and uninvited guest(s). In addition, be aware that Florida wildlife enjoy living by water, such as the coastal lake, and some wildlife can be harmful (such as snakes). As the Registered Guest, you acknowledge certain dangers, agree to vigilantly avoid any issues thereof, and you take responsibility to advise your party of the above. LOSTAND FOUND POLICY Please contact us if you happen to leave something behind. If located, we will make every effort to return your lost items. We are not responsible for lost items we do not find. SECURITY/DAMAGE DEPOSIT and/or NON-REFUNDABLE DAMAGE WAIVER The Damage Deposit Amount and Damage Protection Insurance Policies may vary by booking site. For Guests using the VRBO or Airbnb listing sites - a damage deposit is secured by those companies. RESERVATION TRANSFER POLICY Only the Registered Guest named on this rental agreement may notify us, in writing, of a request to change or transfer a reservation. If approved, a new rental agreement will be issued that must be signed and returned by both parties. No reservations may be shortened or changed 30 days or less prior to the original arrival date. CANCELLATION POLICIES If you booked through VRBO or Airbnb, your cancellation policy is what was in place at the time of booking. If you are concerned about possible cancellation, we recommend obtaining cancellation/travel insurance to cover your trip. There are NO REFUNDS for hurricanes, tropical storms or weather conditions, even if a mandatory evacuation is ordered (optional travel insurance may obtained through a third party. Guest ASSUMES THE RISK). DISPUTES This Agreement/Contract shall be governed by and interpreted in accordance with the laws of the State of Florida and be treated as though it were executed in Bay County, State of Florida. Any action relating to this Agreement/Contract shall be instituted and prosecuted only in the Bay County Court, Florida. You, the Registered Guest, and your party specifically consent to such jurisdiction and to extraterritorial service of process. If any section, clause, paragraph or term of this Agreement is held or determined to be void, invalid or unenforceable, for any reason, all other terms, clauses or paragraphs herein shall be severed and remain in force and effect. This Agreement is taken in full compliance with federal, state and local Fair Housing Laws, without regard to race, color, religion, gender, country of origin, handicap or familial status. We expect the Registered Guest to share this document with the adults in their party. If any legal action or proceeding (including default, non-payments, etc.) arising out of, or related to, this Rental Agreement is brought by either party to this Rental Agreement, the prevailing party shall be entitled to receive from the other party, in addition to all other relief that may be granted, the reasonable attorney's fees, costs and expenses incurred in the action or proceeding by the prevailing party. PRIOR AGREEMENTS No prior agreement or understanding not contained in writing herein shall be effective. Furthermore, the Owner, other than what is specifically written and set forth herein, makes no other or further representation regarding the nature, character and quality of the premises to be rented, and no representation shall be deemed to exist or be material unless and until it is reduced to a writing and signed by the parties. This Rental Agreement may be modified in writing only and must be signed by the parties in interest at the time of the modification. It constitutes the entire agreement of the parties. If any provision in this contract held by any court to be invalid, void or unenforceable, the remaining provisions shall nevertheless, continue in full force. DOCUMENT AUTHORIZATION Please initial all pages of this document outlining the House Rules and Policies, and sign the last page indicating that you, the Registered Guest, have read and agree to the House Rules and Policies as written. We recommend that you provide a copy of this document to each adult in your party. When returning this document, the Registered Guest must include a copy of their driver’s license to confirm they meet the age requirement. CREDIT CARD AUTHORIZATION – Handled by booking platform RENTAL AGREEMENT SIGNATURE I, the Registered Guest, acknowledge and agree to all items contained in this rental agreement.
