Guest Rental Agreement
RENTAL AGREEMENT - RULES AND REGULATIONS
The townhouse is located at 709 Red Quill Way, Winter Park, CO 80482.
1. CHECK-IN TIME IS AFTER 4 P.M. MT AND CHECK-OUT IS 10 A.M. MT. Occasionally we have “back-to-back” days with guest leaving and checking in on the same day, so we ask for flexibility from our guests on these days as our housekeeping crew readies the house.
2. COMMUNITY RULES. Adherence to the Red Quill Village Rules during your stay is required and is posted on the refrigerator in the unit and includes:
Excessive and loud noise and disturbances will not be allowed – Red Quill Village has a mix of full time residents as well as units that are rented out as vacation rentals. This is not a “Party House” and renters need to be QUIET AND RESPECTFUL of their neighbors and their privacy. As per the Red Quill Village Home Owners Association (HOA), there is a STRICT 10:00 pm noise curfew and no use of hot tubs after 11:00 pm.
3. NON-SMOKING UNIT. Smoking by yourself and any and all guests is STRICTLY PROHIBITED in the unit or while on the premises during your stay.
4. PETS. Pets are not permitted in rental units under any conditions as per the Red Quill Village Home Owners Association (HOA) regulations. Upon infraction there is a fine that is charged by the HOA to the homeowner, and if charged, then the guest will be obligated to reimburse the homeowner by infraction of the rules. The current fine is a one-time fee of $100 per pet plus $60 per pet per night for the duration of your stay or lease.
5. MINIMUM AGE. We will not rent to vacationing students or singles under 30 years of age unless accompanied by an adult guardian or parent.
6. PAYMENT. An advanced payment , along with any and all applicable booking fees shall be required at an amount to be determined at the time of booking The BALANCE OF RENT is due as defined by the website and platform you booked your stay (VRBO, Airbnb, etc.) or otherwise 60 days prior to your stay.
7. CANCELLATIONS. The cancellation notice and applicable refund may vary and is detailed on the applicable online platform (VRBO, Airbnb, etc.), so please check the “Cancellation Policy” of the site where you have booked.
The cancellation policy is determined by the booking platform and varies according to the number of days prior to your arrival that the cancellation is made. We highly encourage you to purchase travel insurance in case of some unforeseen circumstance that would cause you to cancel – two options to consider are: 1) www.travelguard.com, and 2) www.insuremytrip.com.
8. DAMAGE. We use this house as our vacation property and expect renters to treat it with a similar level of respect. Any damage to the house, its contents, and property will be the responsibility of the renter. Proof of the damage will be provided and costs for the repair are expected within 60 days of your stay. Should any damages to our property be deemed to be excessive, you agree that we may seek recovery from you under any insurance policies you may maintain and that we may also pursue against you any remedies that may be available under applicable law.
9. MAXIMUM OCCUPANCY. The maximum number of guests is limited to at most eleven (11) persons. Parties and events that exceed this number are not permitted unless prior agreement has been made with us, and may incur and additional charge.
10. MINIMUM STAY. THIS PROPERTY REQUIRES A THREE (3) NIGHT MINIMUM STAY. Longer minimum stays may be required during holiday and busy periods. If a rental is taken for less than three days, you will be charged the three-night rate. Minimum night stays posted on the website are a guideline and will be jointly agreed upon at booking. Subsequent changes after booking must be jointly agreed upon or we reserve the right to cancel and provide a full refund.
11. INCLUSIVE FEES. - Rates include a one-time linen-towel and bath towel setup.
12. NO DAILY MAID SERVICE. While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. We do not permit towels or linens to be taken from the unit.
13. RATE CHANGES. Published rates are subject to change without notice; however, the rate at the time of the booking shall be guaranteed.
14. FALSIFIED RESERVATIONS. Any reservation obtained under false pretense will be subject to forfeiture any and all payments made, and you will not be permitted to check-in, or if discovered after check-in, you will be asked to vacate the property. Additionally, if there is excessive noise and disturbance from renters and there is no change in their behavior, you will be asked to vacate the property.
15. WRITTEN EXCEPTIONS. Any exceptions to these policies must be approved in writing in advance.
16. PARKING. Parking is limited to two (2) vehicles – one in the garage and one on the driveway of the unit - and should not overhang the stree. Vehicles are to be parked in designated parking areas only. Any illegally parked cars are subject to towing; applicable fines/towing fees and is the sole responsibility of the vehicle owner.
17. STORM POLICY / ROAD CONDITIONS. No refunds will be given for storms, inclement weather, or road conditions. While the road to Winter Park is well maintained, we highly recommend four-wheel drive and/or chains during the snow months. However, if the renter is concerned about weather conditions or other events, we highly encourage you to purchase travel insurance to cover such a possibility.
18. HOT TUB. – This property has a hot tub, and the following in in force for you as the renter, your party, and guests during your stay. When using the hot tub, remember there is certain health risk associated with this facility. Use at your own risk. When not using the hot tub, close and lock the hot tub cover, so the hot tub will stay warm and be protected from the cold.
You, your party, and guests will use the hot tub (spa) at your own risk and will be responsible for keeping it secured at all times. We will not be held responsible for any injuries sustained by you, your party, or your guests when using the hot tub. You, your party and your guess agree to indemnify and hold us, as the owner, harmless for any and all actions resulting from any injuries to yourself, y your party or your guests. Children under 18 should be in the supervision of an adult at all times.
You must notify us immediately of any repair that the hot tub may be require or issues that need to be addressed. You understand and agree to grant our hot tub service company access to the hot tub at regular times to maintain the equipment. You understand and agree to refrain from attempting to make any repairs or adjustments to the equipment or to any of the electrical wiring. Additionally, hot tub covers are for insulation purposes and are not designed to support a person or persons. DO NOT STAND ON THE HOT TUB COVERS, they will break and you will be charged for replacement.
You are responsible for the full cost for repair due to damage of the hot tub as a result of fault or negligence by you, your party, or guests. You understand that the hot tub is strictly an amenity and that the use of this amenity is not guaranteed under the terms of this agreement. Any interruption or non-availability of the use of the hot tub will not violate any terms of this agreement.
19. INDEMNIFICATION. – You, as the renter, agree to indemnify and hold harmless us, as the owner, from and against any liability of personal injury, death, or property damage sustained by any person (including your guests) as a result of any cause, unless caused by the gross negligence or willful misconduct of us, as of the owner.
20. ENTRY GRANTED. You agree that we or our respective representatives may enter the premises during reasonable hours to inspect the premises, make repairs, alterations or improvements hereto as we may deem appropriate, or to show the premises to prospective buyers.
20. LIMITATION OF LIABILITY. – In no event shall out liability for damages for any cause, regardless of the form of any claim or action exceed the amount of the rental fees paid to us under this Agreement. We provide no warrantees of any kind or nature, whether express or implied.
21. ASSIGNMENT. You are prohibited from assigning this Agreement or subletting these premises in whole or part without our prior written approval.
